Orchid Bliss, LLC (“we” or “us” or “our”) respects the privacy of our users (“user” or “you”). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our mobile application “Orchid Bliss” (“Application”), our website orchidbliss.com (“Site”) or any other media form, media channel, mobile website, or mobile application related or connected thereto (collectively, the “Platform”). Personal Data

Personally identifiable information, such as your name, address, email address, and telephone number, and demographic information, such as your age, gender, hometown, and interests, that you voluntarily give to us when you choose to participate in various activities related to the Platform, such as registration, user feedback, giveaways, surveys, and reviews. You are under no obligation to provide us with personal information of any kind, however your refusal to do so may prevent you from using certain features of the Platform.

For a better experience while using the Platform we collect information about the devices where you install or access the Platform, depending on the permissions you have granted which may include, but are not limited to, operating system, hardware version, device settings, file and software names and types, battery and signal strength, device identifiers, advertisement identifiers, connection information such as the name of your mobile operator or ISP, language and time zone. To access some features of the Platform, you may be required to connect to a third-party account within the Platform (i.e., Google, Facebook, Apple, Twitter). If you do not grant access you will not have the ability to use some of the features on the Platform.

Derivative Data

Information our servers may automatically collect when you access the Platform, such as your IP address, your browser type, your operating system, mobile device information, location, your access times, and the pages you have viewed directly before and after accessing the Website.

Tracking Technologies

Cookies, Web Beacons, and Tracking Pixels

We use web beacons, tracking pixels, and other tracking technologies on the Platform to help customize the Platform and improve your experience. When you access the Platform, your personal information is collected through the use of tracking technology. You may not decline web beacons

Internet-Based Advertising

We use third-party software from AdThrive to serve ads on the Site. This third-party software may use cookies or similar tracking technology to help manage and optimize your online experience with us. Advertising

This Site is affiliated with CMI Marketing, Inc., d/b/a CafeMedia (“CafeMedia”) for the purposes of placing advertising on the Site, and CafeMedia will collect and use certain data for advertising purposes. Website Analytics

We also partner with selected third-party vendors, such as Google Analytics, to allow tracking technologies and remarketing services on the Platform, to, among other things, analyze and track users’ use of the Platform, determine the popularity of certain content and better understand online activity. By accessing the Platform, you consent to the collection and use of your information by these third-party vendors. You are encouraged to review their privacy policies and contact them directly for responses to your questions. We do not transfer personal information to these third-party vendors. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, we cannot guarantee complete security if you provide personal information.

Rights Related To Your Personal Information

The General Data Protection Regulation or “GDPR” gives certain rights to individuals in relation to their personal data. Sensitive Personal Information

At no time should you submit sensitive personal information to the Platform. This includes your social security number, bank information, or other sensitive personal information. If you elect to submit such information to us, it will be subject to this Privacy Policy.

Policy For Children

The Platform is designed for those 18 years of age or older. We do not knowingly collect any personally identifiable information from anyone under the age of 18. We do not knowingly solicit information from or market to children under the age of 18. Controls For Do-Not-Track Features

Some mobile operating systems include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.

California Privacy Rights

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

If you are under 18 years of age, reside in California, and have provided your personal information with the Platform, you have the right to request removal of unwanted data that you publicly post on the Platform. To request removal of such data, please contact us using the contact information provided below, and include sufficient detail about the public post(s) and a statement that you reside in California. This Supplemental Privacy Notice for California Residents supplements the information contained in the Orchid Bliss, LLC (“we” or “us” or “our”) Privacy Policy and applies solely to all visitors, users, and others who reside in the State of California (“consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (CCPA) and any terms defined in the CCPA have the same meaning when used in this notice.

In the preceding twelve (12) months, we have not sold any categories of personal information (for both minors and non-minors). We do not sell personal information to third parties. While we do not sell your information to any third party in the traditional sense of the word ‘sell’, the definition of ‘sell’ provided in the CCPA is much more broad so we are providing notice that we may partner with third-party service providers and affiliate partners who may gain access to your personal information through the use of beacons, tracking pixels, or cookies.

California Information & Deletion Rights

If you are a California resident, the CCPA allows you to make certain requests about your personal information. Specifically, the CCPA allows you to request us to:

Inform you about the categories of personal information we collect or disclose about you; the categories of sources of such information, the business or commercial purpose for collecting your personal information, and the categories of third parties with whom we share/disclose personal information;

Provide access to and/or a copy of certain personal information we hold about you;

Delete certain personal information we have about you; and

Provide you with information about the financial incentives that we offer to you, if any.

Please note that certain information may be exempt from such requests under California law.  For example, we need certain information in order to provide the Site and Platform to you.

Verification: We will take reasonable steps to verify your identity before responding to a request, which may include, at a minimum, depending on the sensitivity of the information you are requesting and the type of request you are making, verifying your name, e-mail address, and physical address.

You are also permitted to designate an authorized agent to submit certain requests on your behalf. In order for an authorized agent to be verified, you must provide the authorized agent with signed, written permission to make such requests or a power of attorney. We may also follow up with you to verify your identity before processing the authorized agent’s request.

Deletion Request Right

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.

Exercising Access, Data Portability, and Deletion Rights

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.

Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We will deliver our written response electronically using the email address you provide in your request.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

Deny you goods or services.

Provide you a different level or quality of goods or services.

Tracking Technologies

Cookies, Web Beacons, and Tracking Pixels

We use web beacons, tracking pixels, and other tracking technologies on the Platform to help customize the Platform and improve your experience. When you access the Platform, your personal information is collected through the use of tracking technology. You may not decline web beacons

Internet-Based Advertising

We use third-party software from AdThrive to serve ads on the Site. This third-party software may use cookies or similar tracking technology to help manage and optimize your online experience with us. This Site is affiliated with CMI Marketing, Inc., d/b/a CafeMedia (“CafeMedia”) for the purposes of placing advertising on the Site, and CafeMedia will collect and use certain data for advertising purposes. Website Analytics

We also partner with selected third-party vendors, such as Google Analytics, to allow tracking technologies and remarketing services on the Platform, to, among other things, analyze and track users’ use of the Platform, determine the popularity of certain content and better understand online activity. By accessing the Platform, you consent to the collection and use of your information by these third-party vendors. You are encouraged to review their privacy policies and contact them directly for responses to your questions. We do not transfer personal information to these third-party vendors. Once you have used these links to leave the Platform, any information you provide to these third parties is not covered by this Privacy Policy, and we cannot guarantee the safety and privacy of your information. Before visiting and providing any information to any third-party websites, you should inform yourself of the privacy policies and practices (if any) of the third party responsible for that website, and should take those steps necessary to, in your discretion, protect the privacy of your information. We are not responsible for the content or privacy and security practices and policies of any third parties, including other sites, services or applications that may be linked to or from the Platform.

Security of Your Information

We use administrative, technical, and physical security measures to help protect your personal information. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, we cannot guarantee complete security if you provide personal information.

Rights Related To Your Personal Information

The General Data Protection Regulation or “GDPR” gives certain rights to individuals in relation to their personal data. In addition, we offer transparency and access controls to help users take advantage of those rights. As available and except as limited under applicable law, the rights afforded to individuals are:

Sensitive Personal Information

At no time should you submit sensitive personal information to the Platform. This includes your social security number, bank information, or other sensitive personal information. If you elect to submit such information to us, it will be subject to this Privacy Policy.

Policy For Children

The Platform is designed for those 18 years of age or older. We do not knowingly collect any personally identifiable information from anyone under the age of 18. We do not knowingly solicit information from or market to children under the age of 18. Controls For Do-Not-Track Features

Some mobile operating systems include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.

California Privacy Rights

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

If you are under 18 years of age, reside in California, and have provided your personal information with the Platform, you have the right to request removal of unwanted data that you publicly post on the Platform. To request removal of such data, please contact us using the contact information provided below, and include sufficient detail about the public post(s) and a statement that you reside in California. We will make sure the data is not publicly displayed on the Platform, but please be aware that the data may not be completely or comprehensively removed from our systems, nor can we guarantee any cached or archived version of the Platform will remove such data.

The California Consumer Privacy Act (CCPA), enacted in 2018, creates new consumer rights relating to the access to, deletion of, and sharing of personal information that is collected by businesses. This Supplemental Privacy Notice for California Residents supplements the information contained in the Orchid Bliss, LLC (“we” or “us” or “our”) Privacy Policy and applies solely to all visitors, users, and others who reside in the State of California (“consumers” or “you”). In the preceding twelve (12) months, we have not sold any categories of personal information (for both minors and non-minors). We do not sell personal information to third parties. While we do not sell your information to any third party in the traditional sense of the word ‘sell’, the definition of ‘sell’ provided in the CCPA is much more broad so we are providing notice that we may partner with third-party service providers and affiliate partners who may gain access to your personal information through the use of beacons, tracking pixels, or cookies.

California Information & Deletion Rights

If you are a California resident, the CCPA allows you to make certain requests about your personal information. Specifically, the CCPA allows you to request us to:

Inform you about the categories of personal information we collect or disclose about you; the categories of sources of such information, the business or commercial purpose for collecting your personal information, and the categories of third parties with whom we share/disclose personal information;

Provide access to and/or a copy of certain personal information we hold about you;

Delete certain personal information we have about you; and

Provide you with information about the financial incentives that we offer to you, if any.

Please note that certain information may be exempt from such requests under California law.  For example, we need certain information in order to provide the Site and Platform to you.

Verification: We will take reasonable steps to verify your identity before responding to a request, which may include, at a minimum, depending on the sensitivity of the information you are requesting and the type of request you are making, verifying your name, e-mail address, and physical address.

You are also permitted to designate an authorized agent to submit certain requests on your behalf. In order for an authorized agent to be verified, you must provide the authorized agent with signed, written permission to make such requests or a power of attorney. We may also follow up with you to verify your identity before processing the authorized agent’s request.

Deletion Request Right

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.

Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

Exercising Access, Data Portability, and Deletion Rights

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.

Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We will deliver our written response electronically using the email address you provide in your request.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

Deny you goods or services.

Provide you a different level or quality of goods or services.
